1. scope of application
(1) These General Terms and Conditions (GTC) apply to all orders placed by customers via the online shop of the
SOCIUS Organisationsberatung gGmbH

(2) Our offers are aimed at both consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB), unless expressly stated otherwise.
(3) Deviating or supplementary general terms and conditions of the customer shall not apply unless we have expressly agreed to their validity in writing.
2. charitable purpose
(1) SOCIUS Organisationsberatung is a non-profit limited liability company in accordance with §§ 51 ff. AO.
(2) All proceeds from the sale of tickets, books and other products shall be used to realise the charitable purpose of international understanding and international sentiment, development cooperation, education and vocational training, and the promotion of education, culture and social commitment in accordance with the Articles of Association.
3. conclusion of contract
(1) The presentation of products and events in the online shop does not constitute a legally binding offer, but a non-binding invitation to order.
(2) By clicking on the button „Order with obligation to pay“ customers submit a binding offer to conclude a purchase contract.
(3) The contract is concluded when we accept the order by sending an order confirmation by e-mail or when we provide or dispatch the goods or the ticket.
4. products and services
(1) The online shop is used in particular to
- Admission tickets for events organised by SOCIUS Organisationsberatung gGmbH and, where applicable, its partners,
- Books, brochures and other publications/products such as card sets from our own or licensed publications
offered.
(2) Digital tickets (e-tickets) are generally provided by e-mail or download link.
5. prices and shipping costs
(1) All prices quoted are final prices and include statutory VAT, if applicable.
(2) As SOCIUS Organisationsberatung gGmbH is recognised as a non-profit organisation, certain services may be exempt from VAT in accordance with § 4 UStG. In this case, this will be indicated accordingly in the order process.
(3) Shipping costs are displayed in the order process and are to be borne by the customer, unless free shipping is indicated.
6. payment
(1) Depending on the offer, payment is made during the ordering process by
- Prepayment (bank transfer),
- PayPal,
- Credit card or
- other payment methods offered.
(2) If payment is made in advance, the invoice amount must be paid within 7 days of receipt of the order confirmation.
7. delivery and dispatch
(1) Books and other items shall be dispatched to the delivery address specified by the customer.
(2) Tickets are generally provided digitally (e-ticket) or sent by post if expressly requested.
(3) Delivery times are specified in the online shop.
8. right of cancellation
(1) Consumers have the statutory right of cancellation for orders in accordance with § 355 BGB.
(2) The right of cancellation does not apply to contracts
- for the delivery of goods that are not prefabricated and are manufactured according to customer specifications,
- for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed.
For Contracts for participation in educational events (seminars, workshops, courses) applies: A right of cancellation exists in principle, as these are not leisure events within the meaning of Section 312g (2) No. 9 BGB.
The right of cancellation expires prematurely, when
- we have provided the service (the event) in full, after
- you have expressly agreed that we may commence the performance of the service before the expiry of the cancellation period, and
- you have confirmed your knowledge that you will lose your right of cancellation upon complete fulfilment of the contract (Section 356 (4) BGB).

9. reservation of title
The delivered goods remain the property of SOCIUS Organisationsberatung gGmbH until full payment has been received.
10. event participation
(1) The purchase of a ticket entitles the holder to participate in the respective event under the conditions specified therein.
(2) We reserve the right to make changes to the programme or the performing artists/speakers, insofar as these are reasonable.
(3) If an event is cancelled, the ticket price will be refunded. Further claims are excluded.
11. disclaimer
(1) Customer claims for damages are excluded, unless otherwise specified below. The above exclusion of liability shall also apply in favour of the Provider's legal representatives and vicarious agents if the Customers assert claims against them.
(2) Excluded from the exclusion of liability set out in Section 1 are claims for damages due to injury to life, limb or health and claims for damages arising from the breach of material contractual obligations. Material contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract, e.g. the Provider must hand over the item to the Customer free of material defects and defects of title and procure ownership of it. Also excluded from the exclusion of liability is liability for damages resulting from an intentional or grossly negligent breach of duty by the Provider, its legal representatives or vicarious agents.
(3) The provisions of the German Product Liability Act (ProdHaftG) shall remain unaffected.
12. warranty
(1) The Customer's warranty rights shall be governed by the general statutory provisions, unless otherwise stipulated below. The provision in No. 11 of these GTC shall apply to the Customer's claims for damages against the Provider.
(2) The limitation period for warranty claims of the customer is 2 years for newly manufactured goods and 1 year for used goods. For entrepreneurs, the limitation period is 1 year for newly manufactured items and 1 year for used items.
The above shortening of the limitation periods shall not apply to claims for damages by customers due to injury to life, limb, health or property.
for claims for damages due to a breach of material contractual obligations. Material contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract, e.g. the supplier must hand over the item to the customer free of material defects and defects of title and procure ownership of it.
The above shortening of the limitation periods also does not apply to claims for damages that are based on an intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents.
The right of recourse against entrepreneurs in accordance with Section 478 BGB is also excluded from the shortening of the limitation periods.
(3) A guarantee is not declared by the provider.
13. data protection
(1) The collection, processing and use of personal data is carried out in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).

14. dispute resolution
(1) We are not obliged to participate in a dispute resolution procedure before a consumer arbitration board, but are generally prepared to do so.

15. final provisions
(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) If the customer is an entrepreneur, the place of performance and jurisdiction shall be the registered office of SOCIUS Organisationsberatung gGmbH.
(3) Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
